Ownership of Rights: We retain all copyrights and intellectual property rights to the artwork. The purchase of a physical product (e.g., a mug, pillow, or canvas print) does not transfer any copyright, reproduction rights, or ownership of the design to the buyer.
No Unauthorized Use: You may not reproduce, scan, redistribute, modify, or create derivative works from our designs for any purpose without a signed, written license agreement from Forests and Jungles.
Licensing Inquiries: We welcome opportunities for commercial licensing, including surface design, wholesale partnerships, and collaborative projects.
Grant of License: No license is granted by your use of this website. All commercial use requires a separate, formal License Agreement that specifies the scope, duration, territory, and compensation (royalties or flat fees).
Prohibited Commercial Use: Use of our artwork on "Print-on-Demand" sites (such as Zazzle, Redbubble, or Society6), in logos, or as part of a commercial product line is strictly prohibited without an express commercial license.
Copyright Protection: Forests and Jungles actively monitors for unauthorized use of our patterns and designs. We reserve the right to take legal action against any infringement to protect our brand's artistic integrity.
2. Product Information & Artistic Variations
We strive to display our products as accurately as possible. However:
Color Discrepancy: Because our designs originate from hand-painted acrylics and are viewed on various digital screens, we cannot guarantee that the color you see on your monitor will exactly match the physical product.
Handmade Nature: Slight variations in texture or "whimsical" imperfections are a deliberate part of the artistic process and contribute to the uniqueness of each piece.
3. Orders, Payments, and Taxes
Acceptance: We reserve the right to refuse or cancel any order at our discretion.
Payment: All payments are processed through secure third-party gateways. You agree to provide current, complete, and accurate purchase and account information.
Sales Tax: As a business based in Los Angeles, California, sales tax will be applied to all orders shipped within the state of California in accordance with local laws.
4. Shipping and Delivery
Processing: Please allow 14 business days for order fulfillment.
Shipping: Shipping costs and estimated delivery times are calculated at checkout. Forests and Jungles is not responsible for delays caused by the carrier or customs.
Risk of Loss: All items purchased are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
5. Returns and Refunds
Policy: Returns or exchanges are accepted within 5 days of delivery if there is damage to the product, manufacturing error, or if any designs are rendered inaccurately. Customers will need to contact Forests and Jungles within 5 days of delivery and provide a clear photo showing the issue.
Conditions: Items must be returned in their original, unused condition.
6. Limitation of Liability
Forests and Jungles shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of our products or the inability to use our website. Our total liability to you for any claim arising out of these Terms shall not exceed the amount paid by you for the product in question.
7. Governing Law
These Terms and your use of the website are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
